1General provisions

The e-commerce website www.winkall.be is operated by Winkall BV, trading under the name Winkall, a private limited company with its registered office at Hoogkamerstraat 108E, 9140 Temse, Belgium.

These general terms and conditions apply to every order placed via the webshop. By placing an order, the customer declares to have taken note of these terms and conditions and to accept them without reservation.

2Prices

All prices are expressed in euros and include VAT and all other statutory levies. Any delivery, administration or payment costs will be stated separately.

The stated prices apply exclusively to the products as described in the offer. Images are purely decorative and may contain elements not included in the price.

3Offer

Winkall compiles its offer with the greatest care. Nevertheless, errors or omissions may occur.

Obvious errors or material mistakes do not bind Winkall. The offer is valid while stocks last and can be changed or withdrawn at any time.

4Online purchases

The ordering process is as follows:

1. The customer selects the desired product and adds it to the shopping cart.
2. The customer enters their details and chooses a payment method.
3. The customer confirms their order and receives a confirmation email.

Winkall accepts the following payment methods: Bancontact, Belfius, Visa, Mastercard, Maestro, American Express, iDEAL, PayPal, Apple Pay and Google Pay. The currently available payment methods are always shown at checkout.

Winkall reserves the right to refuse orders in case of serious shortcomings by the customer.

5Delivery and execution of the agreement

Orders are delivered via DPD, unless stated otherwise. Delivery is possible in Belgium, the Netherlands, Germany, France, Luxembourg and Austria.

For Belgium and the Netherlands, the average delivery time is 2 to 4 working days after receipt of payment. For shipments to Germany, France, Luxembourg and Austria, the delivery time may be longer; we cannot guarantee a fixed period for this.

The goods will be delivered to the address provided by the customer.

The risk of loss or damage transfers to the customer as soon as they or a third party designated by them has physically received the product.

6Retention of title

The delivered articles remain the property of Winkall until full payment has been received.

The customer undertakes to inform third parties of this retention of title if necessary.

7Right of withdrawal

The consumer has the right to withdraw from the agreement without giving any reason within 14 calendar days of receipt of the goods.

To exercise the right of withdrawal, the customer must inform Winkall (Mont Kiara, Hoogkamerstraat 108E, 9140 Temse, info@winkall.be) of their decision to withdraw from the agreement by means of an unambiguous statement.

The customer can use the model withdrawal form for this purpose. The customer must return the goods to the above address within 14 calendar days of notifying the withdrawal.

8Warranty

The legal warranty of two years applies, in accordance with article 1649quater of the old Civil Code.

The warranty applies from the delivery of the product and covers any lack of conformity that manifests itself within this period.

The warranty does not cover damage caused by improper use, wear and tear or lack of maintenance.

9Customer service

Winkall's customer service can be reached via info@winkall.be or by phone at +32 471 88 25 16.

Complaints can be submitted by email or post. Winkall aims to process every complaint within 5 working days.

10Sanctions for non-payment

In case of non-payment within the foreseen period, the customer will receive a free reminder to settle the outstanding amount within 14 calendar days.

If payment is not made, costs and interest may be charged in accordance with Book XIX of the Code of Economic Law.

11Privacy

Winkall processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Belgian privacy law of 30 July 2018.

Your data will only be used for order fulfillment, customer management, marketing purposes and legal obligations.

12Use of cookies

Our website uses cookies to improve your user experience. Only functional cookies are automatically placed.

13Invalidity — non-waiver

If a provision of these terms and conditions is declared invalid or null and void, this shall not affect the validity of the remaining provisions.

The non-exercise of a right by Winkall cannot be considered a waiver of that right.

14Amendment of terms and conditions

Winkall reserves the right to amend or supplement these terms and conditions.

The new terms and conditions apply to orders placed after the amendment.

15Proof

The customer accepts that electronic communication and backups can serve as proof.

16Applicable law and disputes

Belgian law applies.

In the event of disputes, the courts of the consumer's place of residence shall have jurisdiction.

The consumer can also turn to the European ODR platform (ec.europa.eu/consumers/odr).
